WAAAAAA, I'm Whining Jeff, you are right, other one started first, and I am sure someone will bring it to this guys attention and he will stop the auction, but, if they both played all the way to the end, he would have some degree of civil liability to the high bidder as Ebay does constitute a "Binding Contract" under the law, there have been cases on big ticket items where it ended up in court if the buyer didnt follow through, the seller is held to the same degree of responsibility to follow through with the transaction. On something of this value it would not be worth the time, but if you were bidding on a $150,000 car and the auction clocked out the seller does have to sell to you if reserve was met.
